The Final Straw: Luke O'Donovan; Police Murders from coast to coast

This week's episode features three, that's right, three whopping conversations. Firstly, we hear from Luke O'Donovan about his case. Luke is an Anarchist in the Atlanta area who defended himself against a queer bashing last New Years at a party. Luke suffered multiple wounds inflicted by knives as well as beating which sent him to the hospital. He's facing 5 charges of aggrivated assault with a deadly weapon for injuring the people attacking him, who'd earlier called him a faggot repeatedly. Each of those 5 charges could carry a twenty year sentence.

After that, we'll hear from Rafi, an organizer in Durham North Carolina, about the spate of police murders of young men of color in that city. Particularly we'll talk about the case of Jesus Chuy Huerta, a 17 year old latino man shot in the back of a patrol car while handcuffed that the police are claiming was self-inflicted.

Finally, we'll hear from Jess who's been organizing alongside youth in Santa Rosa, california since the shooting death by Sheriff's there of 13 year old Andy Lopez for having a toy gun. The fatal shooting of Andy Lopez fell on October 22nd of this year. For those who don't know, October 22nd is a day when many people in the United States remember those killed and imprisoned by police and protest against police violence.

Intro:

I may post more in the comments, additional parts if I am so inclined, either as a response to challenges, questions, or remarks, or as some more spontaneous development.

I realize some may have been/ may be supporting Luke by posting, reposting, or linking, without much research or dwelling on the situation.

I endeavor to mostly just "walk through" the already available information. To bring it the foreground. I will provide a few personal anecdotes to help it click.

Of course there are some that are aware of the facts and do not care or do not consider the events snitching and collaboration. There are some that when they read this may grant that everything I say is true yet declare that the name, the label of snitch and collaboration does not fit. This is what happened, for example, during the John Drury case in many instances. I imagine Luke and the website writers, and some of the supporters, will fall into this group; however I will, during the writing of this article, parse the situation at various points, and at least allow for the possibility, the question of Luke's, the supporters, some of the supporters etc, unawareness to arise.

Another imagined audience is those who have ignored the case up to now, or are unaware of it. Those who are interested in situations of snitching, and those who are interested in making it hard on people who snitch.

Background:

On New Years Eve, New Years Day, Luke of Donovan went to the hospital. They had at least one cut on their back. At the hospital they were arrested and charged with five counts of aggravated battery with a weapon, accused of stabbing five individuals at a party earlier.

There was a meeting on January First. This was mostly a group of anarchists, Luke's friends. A couple days later there was a more diverse meeting of anarchists, liberal-anarchists, communists, and members/"representatives" of the radical queer community. There a "town hall" meeting was planned, for all those that were concerned.

Posters were placed around town. Gay and queer bars were specifically targeted. Letters/story requests were sent to Gayvoice and Project Q, two LBGTQ etc. magazines. I don't know if letters/story requests were sent to other newspapers. GaVoice and Project Q eventually posted stories. A reporter from GaVoice was at the town hall; one of Luke's lawyers Schwarz interviewed with Project Q, another, PIne, with GaVoice. Schwarz stated that they were seeking a dismissal based on a self defense; Pine did as well, in addition adding that Luke would cooperate with the police when they got out. I do not know if those lawyers are still Luke's.

The town hall happened on January 13th.. Someone invited the televisual media. They were told to leave (by some more then others), but a couple people were encouraged, once again by some, to go out and talk to them as they were forced out. At this meeting there were more radical queers and queers. A statement was read by the same representatives at the earlier meeting, acting as the moderator of this meeting, declaring that Luke had been kissing and dancing with men before the incident and been called faggot. This information had previously been posted on the Atlanta Black Cross website.

During the same time anarchists and other individuals were sending character witness to the judge/ judges/ the county ( I don't know to who exactly.) These were attempts to establish Luke as law abiding and good hearted, etc. Some of these character witness were written by people who had been at the party and left before the incident. In them it was mentioned that Luke was happy and not drunk before the party, that Luke was dancing with men etc.

One person had been there during the actual incident. I do not know if they made a character report. They did go to the police, attempting to establish that Luke had not left and come back with a knife, that Luke was defending themselves, Luke was fleeing.

This person, and possibly others, were encouraging those outside the anarchist scene, those who had been there during the incident to make witness statements to the police, declaring Luke to have been the victim. This person was Luke's partner.

Despite what the support site says, this was something that was happening and discussed, around many people. Perhaps it ceased and the statements after a certain point began to only be sent to the lawyers. I will deal with the interactions between the lawyers and witness later, and what I find despicable about them.

A statement was released on Atlanta Black Cross on January 2. A follow up, an elaboration, was released a one the 3rd, by the same people, on a newly created page (let luke go.com) I will post both of these.

The Website:

It has been reported in the press that Luke O’Donovan, 19, went on a “stabbing rampage” at a New Year’s Eve party in Reynoldstown, a neighborhood in Atlanta, GA. This is not accurate. The events that occurred were the result of Luke O’Donovan desperately defending himself against a clear act of queer-bashing that included Luke being stabbed in the back.

Some facts of the situation remain unclear, but the events that have been reported thus far are inaccurate. Narratives have described Luke O’Donovan, 19, as having returned to a house party that he had been kicked out of. The reports state that Luke returned with a knife and stabbed one person, and then 4 others who attempted to subdue Luke.

As multiple witnesses have testified and will testify, Luke was never kicked out of the party and did not leave. He remained at the house where the party was occurring up until the incident. This basic fact, and the fact that it has been misrepresented, changes the story as it has been reported thus far. Luke is being portrayed as having gone on a nearly unfounded “stabbing rampage” comparable to recent mass killings. This is false. Luke did not go to the party intending to initiate conflict with anyone. Just fifteen minutes before the fight, Luke was present in the living room of the house, having a pleasant and friendly conversation with other people at the party.

Although the exact sequence of events is unknown at this point, it is clear that Luke was attacked by several people at one time and retaliated in self-defense in an attempt to escape the attack. Several witnesses have reported watching between 5 and 12 men mobbing up on Luke and stomping on his head and body with the intent to kill him. The people who were stabbed during the conflict were not attempting to end the fight with Luke. The altercation was never limited to Luke and one other person, but involved several people mobbing up on him.

The motivations of the attack on Luke seem to originate in the fact that he had been seen dancing with and kissing other men earlier at the party. Luke was repeatedly insulted with homophobic slurs throughout the night. The men who attacked Luke are known to have exhibited homophobic language and behavior in the past. Luke was called a faggot during the fight. This provides clear evidence that the attack on Luke was in some way motivated by homophobia and perpetrated by multiple men while Luke was alone.

Luke is currently the only person involved in the fight who is in jail. We do not support the prison industrial complex, talking to the police, or snitching. We do not believe that the other side of the fight should be imprisoned, but rather that the incident should be resolved outside of the institutions of the State.

The second post:

A Few Clarifying Points from the Support Committee (in Other Words: Please Get Involved!)

A few concerns have been raised thus far about the way in which the support committee has been handling Luke’s defense. People have expressed concerns about the way in which Luke’s family is being involved, on the strategy and rhetoric being used by the support committee, and about the support committee’s alleged advocacy for “vigilante justice.” We would like to take some time to respond to these concerns in online form, but we strongly encourage people to get in contact with those involved in Luke’s support team to air any disagreements, and refrain from strictly communicating over social networking sites (Facebook). We are writing as Luke’s close friends, ones he eats and sleeps with everyday, ones with whom he often speaks about his beliefs, and ones who have been in contact with him since he has been in jail. We know and love Luke deeply, and want everyone who feels similarly to get involved in his defense.

First and foremost: What is Our Purpose?

Our purpose is to support Luke materially and emotionally throughout this trial and for however long he needs us immediately following the trial. Our first priority is Luke’s release from jail. Afterword, we believe that Luke should be acquitted of all charges against him. We are fighting toward this end through contact with lawyers and, hopefully, popular mobilizations with others who desire to support Luke however they can. We are also doing our best to meet Luke’s emotional needs in light of this because we have known the torment of incarceration and the effect it can have on your spiritual and mental well-being.

While it may come to pass that Luke’s attackers receive charges for what they have done, that is not the focus of this support group. Our focus is Luke. We understand that the judicial system has legs all of its own and will act how it sees fit. Our intention, however, is to focus our energy on the person we all love and supporting them to the fullest.

On Talking to the Police

We would like to clarify our position regarding talking and interacting with police around Luke’s case. We have asked several lawyers for advice, and they have all said basically the same thing to us. At this point it is better for witnesses to go to an attorney and give their testimony together with a lawyer. Luke is already in jail, and it is not up to the police to let him out, but the legal system. We recognize that in Luke’s case it will be impossible to exonerate him without going through the legal system. After talking with lawyers from several prominent legal associations we believe that it is not in Luke’s best interests for people to immediately head to the police station and offer their testimony. We would love for as many people to come forward in Luke’s defense as possible, and to help them get their testimony done through attorneys. To be clear we are not telling people to stay away from testifying for Luke. We just want it be done in a way that best benefits his case. Once a lawyer or specific legal representation has been decided upon or assigned to Luke we will immediately release their contact information, in order to ensure that anyone who wants to help him with their testimony, eye-witness account, or character witness statement can do so in the most efficient way possible. On Lawyers and Legal Support

On the note of legal support, we have been in contact with lawyers from the NLG, the public defender’s office, the Occupy Atlanta legal team, and we are working on getting in touch with other attorneys from various legal associations of note. We are trying to secure the best possible legal team available for Luke because we know that this is very serious. At this time, the public defender seems like an efficient option because they work with the judge every day. If we need another lawyer moving forward, which we very well may, we will probably need to pay for one.

On Fundraising

The WePay account that has been set up for Luke will collect money for several purposes. So far it has accumulated over $600 in just 24 hours. Money from the WePay can be used to pay for Luke’s bail, if it is set, for Luke’s legal defense, and to keep money in his commissary. For those who may be unsure as to how jail works, Luke’s commissary fund allows him to buy items in jail, including vegan food items and stamps to send letters. Luke’s commissary currently has a balance of 83 dollars, separate from the WePay. Luke also has an Amazon Wish List, with a list of books he would like sent to him in jail. Unfortunately, we anticipate Luke being in jail for some time, and books are a great way to pass time while imprisoned. In fact, being locked up with nothing to read leaves one in a state of extreme boredom and isolation. Luke requested books be sent when we spoke to him over the phone, and so we are working hard to fulfill this wish. Jail is a miserable place and we want to do what we can to make sure Luke is as comfortable as possible on the inside.

On Allegations of Vigilantism

Some of the language used in the initial post by the support team may have been unclear. For this we apologize. It was imperative to get a statement out ASAP to counteract the dominant media narrative that Luke went on a “stabbing rampage.” Although personally we do not believe the justice system offers justice to anyone, we recognize that it is an existing reality and that we must move through it to free Luke. WE ARE NOT CALLING FOR VIGILANTE JUSTICE. We are doing our best to respect Luke’s own beliefs and desires, as well as our own, while doing the most intensive and thorough defense work possible.

Again we would like to reiterate that for people who have concerns about how Luke’s defense is being handled, it is best to talk about it in personal conversations, not through social networking sites. We want as many people around to help defend and support Luke as possible. With that said, we plan to announce a public meeting soon. We are currently building a website that will make broad participation easier for people.

Snitching and Collaboration:

1) In the beginning, statements were being given directly to the police.

2) Pine stated that Luke would cooperate with the police.

3) Even if there is no direct communication with the police, this does not solve the problem but merely pushes it back a stage. The supporters strategy, the lawyers strategy, Luke's strategy, is to frame the incident as one of self defense. To frame the incident as one of self defense not only to the media but to the judges, juries, and prosecutors! Even if this does not lead to charges being brought against the accusers, it put them at that risk. Information that the lawyers, with the support of anarchists and certain witness, are, have been, and will give to the judge and prosecutors is opening up the possibility of charges. Information is being given to the state. Information concerning supposed crimes is being given to the police. The anarchist support site declares that Luke will go to trial, that the goal is to get the charges dropped; that Luke and the support crew are going to go through the legal system and try to "win.".

Here are some quoes by the lawyers. I have recall personal encounters with them that attest that this was their position. "

“It is certainly our goal [to have the charges dropped,” Schwarz says. “Our goal is to establish what happened out there. There are a lot of people to talk to. We are going to start investigating the case and what we can prove to show [prosecutors] that Luke was acting in self defense as opposed to the one that initiated the case. "Wednesday is the preliminary hearing and hopefully we will have a chance to seek bond at that time," said Noah Pines, attorney for O'Donovan.

At his first hearing before a magistrate judge after he was arrested, O'Donovan was denied bond.

O'Donovan has not spoken to officers with the Atlanta Police Department about his case, Pines said.

"It is my understanding a separate detective has been assigned to investigate this case with Luke being the victim, which he was in this case," Pines said. “He had at least five people attacking him."

Officer Kim Jones, spokesperson for APD, confirmed today a detective is working on whether O'Donovan was a victim in the incident. Police also continue to investigate the case with O'Donovan as the defendant.

Pines said it is not useful for O'Donovan to speak to an officer through a pane of glass at the jail and that if O'Donovan is released on bail Wednesday he will cooperate with police in their investigations.

Is this all the supporters strategy? It is certainly the writers of the two support statements. They are comfortable with the idea of the accusers catching charges, as seen above. Comfortable or willing to accept immense cooperation with the police and the courts. What about the other anarchists in Atlanta? The other supporters? What about all those who reposted or created facebook pages, etc?

Does Luke know? Luke has been out for a while. They talked with their lawyers. They talked with the website makers. The websites are still up. They talked with their partner, with the website writers, with some of those that had submitted character witness reports, with some supporters. They have hung out with them. The most recent post was in September 15th, and there was one 15 days later on A-News. They know. They are in support of snitching. Have they said anything directly to the police? By now, yes I think they have.

Let us say the lawyers, Luke, the supports are making a feint, a ploy, playing a game. The lawyer isn't actually going to try to win the trial with a self defense plea, or even go to trial. It's all a means of intimating the accusers. This doesn't matter. They are already given information to the law, and they are making the threat of giving more to come. They are making the threat of snitching and collaboration.

A few days after the incident police announced they are looking into the possibility of a hate crime. In addition, In a great deal of situations the state can carry out charges without the support of the victims.

4) Luke went to the hospital, supposedly after a fight, supposedly after receiving stab wounds. This put the alleged attackers at great risk. Did they do this merely because they were scared, or was it to begin to establish the self defense case early on? I don't know. The mere fact of going to the hospital in a case like this is disturbing to me. I saw the wounds. I saw them up close, after they were stitched, after 15 or so days of them being received.. There was one or two cuts, and they did not look deadly. Snitches get stiches indeed.

Conclusion:

Where are they now? The sites are still up. There has been a new update, less then two months ago. Things are still relinked and reposted. Sites and people farther away continue to host the posts; and have posted no corrections. Nothing antagonistic or contradictory has appeared. There were some resistances during these events, but they felt quiet, for the most part. Or they did not question more then one aspect of the situation. There were some resistances that were inarticulate or indirect. Some left Atlanta to go elsewhere, either ceasing support or giving it in their new cities, some who had already been away (who had returned for the meetings, to support a friend) probably removed themselves once again, I imagine. Some people spoke of getting tattoos memorializing and commemorating the events. I do not know if they have. I don't believe many that are directly involved are too uneasy.

There are many responses. The withdrawal of support. The beginning or intensification of anti-support. Every moment this juridical proceeding continues there is the potential for more information to be given to the police, and the potential for more police actions based on that information. For more collaboration. They want to use the money for the trial. They want to use the money to help Luke.

And what would I do in Luke's condition? There are several possibilities. Am I giving advice to Luke? No. I have nothing positive to say here for Luke, the website writers, the partner, all those that submitted character witness reports and talked with the police, all those that supported deeply, knowledgably. I have nothing good for goddam snitches and collaborators. No; this is for a different sake.

One is to engage in extra-legal activity. I will leave it at that. Another is - I was reading this interview with a singer and they said this:

"This fucking rattin shit man, this shit here is getting out of hand. Man it's called T-Y-C. 'Take Your Charge."

First: It's a desperate attempt at snitch-jacketing to say that claiming self-defense is in tune with collaboration. Neither Luke nor Luke's lawyer has given any information to anyone trying to pursue prosecution on Luke's attackers. The prosecutor in Luke's case would not be the prosecutor for any (currently nonexistent) charges brought up against his assailants.

Second: If I remember correctly Luke's support committee has always asked people to give information to Luke's lawyers instead of the police. Anyone saying to give information to the police was most likely a concerned (albeit misguided) friend or family member. The support committee in fact released a statement asking anyone with information about the incident not to funnel it to the police, and instead to Luke's lawyer.

Third: What the hell does "getting tattoos memorializing and commemorating the events" have to do with anything you fucking cop?

Why does it got to be snitch-jacketing? Doesn't that mean the person is being "careless" or "malevolent"? Maybe I just have a different definition of what snitching is! Why can't we just talk about it??

A partner that was, during that time, (I don't know about now) a involved part of the "anarchist community", and around during most of the planning and discussions.

Also, Luke's lawyer at the time said Luke would cooperate directly with the police (beyond just talking in court, to a judge, to a jury etc about how they had been talked.)

You can invent whatever "support committee" you want, can invent whatever group you want, and give it whatever opinions and stances you wish, set whatever boundaries of who is in it and who is out of it you choose (those who write the statements in, family members out/don't count), have it make whatever statements you desire, but that doesn't cover, exhaust, and control the totality of the situation. There was more going on then what the support committee spoke of, things going on beyond the page and the internet, involving many people. (although the support committees statements were fucked up enough in them selves.)

Wow, you cops really need to work on not sounding like cops so much. Sheesh.

Since I know that cops hunt at hospitals, I always refuse to go to a hospital for injuries from any fight, win or lose. May shorten my life,but has kept me out of prison more than once. In a street fight you may never even be identified if you take cover and disappear afterwards, thus preventing any warrants from ever existing.

As for the "snitch" allegation, gaybashers are ENEMIES of our community. Snitching means talking to the police about ONE OF YOUR OWN, and gaybashers and rapists don't count. Not only is Luke not a snitch by this definition, the gaybashers may be snitches. Someone had to get the cops into this case, and who is pressing charges here?

It seems to me that Luke was snitched on, not the snitch.By choosing to involve the pigs, the gaybashers consent to whatever Luke decides he has to do to defend himself against their second round attack.

You know luke I'm really surprised. Wow. I'm really surprised you haven't responded. You were a really "good guy." Really "sincere" and "posi". Really "honest". I'm surprised you haven't responded to these allegations. The luke I knew would have fought to protect their honor, to stop their name from being dragged through the mud. Would have wiped the spit off their face. Why did you never issue any sort of post retracting your lawyers statement? ha, you speak of an anti-snitching ethic and keeping it clear when YOU call people cops and robots at the slightest provocation. Anyone you really cared about detecting cops, preventing information from going to the cops etc, wouldn't just resort to the label as an attack whenever they felt uncomfortable. It would have more value and intensity to them. They would have more scars and heaviness's. You are not interested in detecting cops and you are not interested in that being a burden or task of yours, or inhabiting a place where such a search would be a constant concern and dilemma, a nightmare and a labythrine; you are interested in parlor games. That is what I mark you as. Not interested, or not fit, temperamentally.

You're on your own, kiddo. If you want to argue that "defending yourself in court = snitching," you're on your own.

You want a world in which people can attack anarchists and then charge the anarchists with assault, and the anarchists won't even be able to defend themselves in court without losing solidarity. That makes perfect sense for the state (and anti-anarchist vigilantes), and no sense to those in struggle against the state and its defenders.
